These Terms of Use ("Terms") govern your use of the Beany iOS application ("the App") provided by Martin Schreiter ("we", "us", "our"), located at Unterer Stichweg 12, 72770 Reutlingen, Germany.

By downloading, installing, or using Beany, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 16 years old to use Beany. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account

2.1 Registration

To use Beany, you must create an account using Sign In with Apple. You are responsible for maintaining the security of your Apple ID. One Beany account is permitted per Apple ID.

2.2 Account Security

You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized access.

3. Subscriptions and Payments

3.1 Free and Premium Tiers

Beany offers a free tier and a premium subscription ("Beany Pro"). The free tier includes limited access to certain features. Premium unlocks the full experience, including unlimited dial-in sessions, brew suggestions, photo attachments, and full brew history.

3.2 Subscription Terms

  • Beany Pro Monthly: Auto-renewable subscription billed monthly.
  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscription automatically renews unless it is canceled at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
  • Prices are displayed in the App and may vary by region. All prices include applicable taxes where required.

3.3 Managing Your Subscription

You can manage your subscription and turn off auto-renewal in your device's Settings > Apple ID > Subscriptions at any time. Cancellation takes effect at the end of the current billing period — you retain access to premium features until then.

3.4 Free Trials

If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription.

3.5 Refunds

All purchases are processed by Apple. We do not handle payments directly and cannot issue refunds. To request a refund, visit Apple's Report a Problem page or contact Apple Support. Refund eligibility is determined by Apple in accordance with their policies and applicable law.

3.6 Price Changes

We may change subscription prices at any time. Apple will notify you of any price increase before your next renewal. You will have the opportunity to accept the new price or cancel before it takes effect.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, for your personal, non-commercial use, subject to these Terms.

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any unlawful purpose
  • Sublicense, rent, or lease the App to third parties
  • Use automated means to access the App

5. Your Content

5.1 Ownership

You retain ownership of all content you create in Beany, including beans, recipes, brew logs, dial-in sessions, and photos ("Your Content").

5.2 License to Us

By using the App, you grant us a limited license to store, process, and display Your Content solely to provide and improve the App's functionality. We do not claim ownership of Your Content and will not use it for any purpose unrelated to operating the App.

5.3 Content Responsibility

You are solely responsible for Your Content. We do not monitor or endorse user content.

6. Data and Sync

6.1 Cloud Sync

Beany syncs your data to our servers (Supabase) so you can access it across devices. An internet connection is required for sync. Without connectivity, the App operates in offline mode using locally cached data.

6.2 Data Integrity

We take reasonable measures to protect your data but cannot guarantee that data will never be lost, corrupted, or temporarily unavailable. We recommend keeping the App updated to the latest version.

6.3 Local Data

In rare cases (such as database schema changes during updates), local cached data on your device may be reset. When this happens, your data will re-sync from the server.

7. Third-Party Services

The App relies on the following third-party services:

  • Supabase — Data storage, authentication, and file hosting
  • Apple — Sign In with Apple, StoreKit (payment processing), App Store

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or performance of third-party services.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure
  • Results obtained from the App (including brew suggestions and dial-in recommendations) will be accurate or reliable
  • Defects will be corrected in any particular timeframe

Brew suggestions and dial-in recommendations are informational only and should not be relied upon as professional advice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for fraud or gross negligence.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including reasonable legal fees) arising from your breach of these Terms or your use of the App.

11. Termination

11.1 By You

You may stop using the App at any time. To delete your account and data, use the account deletion feature in the App's Settings.

11.2 By Us

We may suspend or terminate your account if you violate these Terms. We will make reasonable efforts to notify you beforehand, except in cases of serious or repeated violations.

11.3 Effect of Termination

Upon termination, your license to use the App ends. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, through an in-app notice. If you continue to use the App after changes take effect, you accept the updated Terms. If you do not agree, you should stop using the App.

13. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law provisions.

For EU residents: Nothing in these Terms affects your rights under mandatory EU consumer protection law. You have the right to bring legal proceedings in the courts of your country of residence.

Any disputes that cannot be resolved informally should be submitted to the competent courts in Reutlingen, Germany.

14. EU Right of Withdrawal

If you are a consumer in the EU/EEA, you have a 14-day right of withdrawal from the date of purchase. However, by purchasing a subscription through the App Store and consenting to immediate access, you acknowledge that you lose your right of withdrawal once the digital content has been delivered. This is handled by Apple at the point of purchase.

15. Notice Regarding Apple

This agreement is between you and Martin Schreiter only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.

  • Apple has no obligation to provide maintenance or support for the App.
  • In the event of a failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability, legal compliance, or intellectual property claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you.
